Terms of Service

By downloading, installing or using SwellPilot (“the App”) you agree to these Terms. If you do not agree, do not use the App. These Terms form a legally binding agreement between you and OÜ Datadaa, the operator of SwellPilot.

SwellPilot provides surf-spot recommendations based on ocean forecast data from third-party providers. The App is provided for informational purposes only.

Surfing is an inherently dangerous activity. SwellPilot is a helper tool, not an ultimate source of truth and not a substitute for your own judgment. You are solely responsible for deciding if, when, and where to surf, for assessing your own skill level, and for checking real-world conditions before entering the water. Always follow basic safety practices, including respecting local rules and hazards, avoiding unsafe conditions, and not surfing alone.

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@swellpilot.com if you suspect unauthorised access.

SwellPilot offers a free tier and a premium subscription (“SwellPilot Pro”). Premium features are unlocked upon a successful in-app purchase processed by the platform billing system.

• Billing: Subscriptions are billed to your platform account at confirmation of purchase and auto-renew at the end of each period unless cancelled at least 24 hours before the renewal date.
• Cancellation: Manage or cancel your subscription in iOS Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period — we do not offer pro-rata refunds.
• Refunds: Refund requests must be submitted through the platform billing channel. We do not process refunds directly.
• Price changes: We will notify you at least 30 days before any price increase. Continued use after the change date constitutes acceptance.

The free tier provides access to surf recommendations within a 100 km radius and an 8-hour forecast window. Free tier features may be changed or limited at any time with reasonable notice.

You agree not to:

• Reverse-engineer, decompile or disassemble the App
• Scrape, crawl or harvest data from the App or its API
• Use the App to build a competing product
• Circumvent any access controls or rate limits
• Use the App in any way that violates applicable law

All content, design, code and data in SwellPilot are owned by or licensed to us. You receive a limited, non-exclusive, non-transferable licence to use the App on your personal device. No other rights are granted.

The App is provided “as is” without warranty of any kind, express or implied. We do not warrant that forecasts are accurate, complete, or suitable for any particular purpose. Forecast data may contain errors, and you must independently verify actual conditions before entering the water.

You use SwellPilot entirely at your own risk. To the maximum extent permitted by law, SwellPilot accepts no responsibility or liability for any loss, damage, injury, or claim arising out of or related to your use of the App, reliance on any recommendation, forecast, or score, or your decision to enter or not enter the water. This includes direct, indirect, incidental, special, consequential, or punitive damages, and loss of profits or revenues. Where a total exclusion is not legally permitted, total liability is limited to the amount you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be excluded by law (including for fraud or willful misconduct).

The App integrates with third-party services for payments, authentication, subscription management, and forecast data. Your use of those services is governed by their respective terms. We are not responsible for the availability or accuracy of third-party services.

You may stop using SwellPilot at any time and delete your account from the Profile screen. We may suspend or terminate your account if you breach these Terms or if we discontinue the service, with reasonable notice where possible.

We may update these Terms from time to time. Material changes will be communicated via the App or email at least 14 days in advance. Continued use after that date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Finland, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Helsinki, Finland, unless mandatory consumer protection law in your jurisdiction provides otherwise.
